Form I-912 in short
Form I-912 asks USCIS to waive the filing fee for certain immigration forms because you cannot pay. You qualify on one or more of three bases: you receive a means-tested benefit, your household income is at or below 150 percent of the Federal Poverty Guidelines, or you have a financial hardship. It only covers forms on the USCIS eligible list.

What changed
The current edition is 07/22/25. USCIS also accepts prior editions or a written request. Pub. L. 119-21, signed July 4, 2025, created extra fees for some forms that cannot be waived. For Form I-765 in certain categories, Form I-131 parole EAD requests, and initial Form I-821, you may still ask to waive the separate USCIS fee.

Common mistakes to avoid
- Requesting a waiver for a form that is not on the USCIS eligible list. USCIS can only approve waivers for listed forms and categories.
- Filing Form I-912 for DACA. USCIS says there are no fee waivers for DACA.
- Sending a benefit letter without a current date or effective period. The evidence must show the benefit is received now.
- Using Medicare, unemployment benefits, Social Security retirement, SSDI, or student aid as a means-tested benefit. The instructions say these do not count.
- Mailing Form I-912 separately or after the application. It must go with the application.
- Leaving out a Pub. L. 119-21 fee. Those fees cannot be waived and must be paid even with an approved waiver.
- Forgetting to sign. USCIS rejects unsigned requests.
